COSMETICS: REGULATION (EU) 2018/1847 amendments to Annex V o-Phenylphenol

On November 26, 2018 the Regulation (EU) 2018/1847 was published.

The substance biphenyl-2-ol, and its salts, which have been assigned the names o-phenylphenol, MEA o-phenylphenate, potassium o-phenylphenate and sodium o-phenylphenate in the INCI Nomenclature, are currently authorized as preservatives in cosmetic products to a maximum concentration of 0.2% (in phenol) in ready-to-use preparations.

The SCCS concluded in its opinion of 25 June 2015, on the use of o-phenylphenol as a preservative, that a maximum concentration of 0.2% in cosmetic products not to be rinsed is not safe, while a maximum concentration of 0.15% in such products can be considered safe, and that a maximum concentration of 0.2% in cosmetic products to be rinsed is considered safe. The CSSC also concluded that the o-phenylphenol substance could potentially cause eye damage. It should also be indicated that eye contact should be avoided. The use of sodium o-phenylphenate, potassium o-phenylphenate and MEA o-phenylphenate as preservatives should not be authorized.

Consequently, as from 17 June 2019, cosmetic products containing:

the biphenyl-2-ol substance and which do not meet the conditions set out in this Regulation.
sodium 2-biphenylate, potassium 2-biphenylate or 2-aminoethan-1-ol; 2-phenylphenol as preservatives.

This regulation applies from 17 June 2019.
