REACH: Implementing Regulation (EU) 2018/2005 amending item 51 of Annex XVII of REACH

On the Official Journal of the European Union the Regulation (EU) 2018/2005 was published, which modifies Annex XVII of the REACH Regulation.

The Regulation modifies item 51 of Annex XVII which applies to phthalates such as:

  • bis (2-ethylhexyl) phthalate (DEHP) (CAS 117-81-7);
  • dibutyl phthalate (DBP) (CAS 84-74-2);
  • benzylbutyl phthalate (BBP) (CAS 85-68-7);
  • diisobutyl phthalate (DIBP) (CAS 84-69-5).

In particular, the restriction provides that:

  • substances (either singly or combined) as such or as components of mixtures can not be used in a concentration equal to or greater than 0.1% by weight of the plasticized material;
  • Toys and childcare articles containing the first three phthalates (either singly or combined) may not be placed on the market in a concentration equal to or greater than 0.1% by weight of the plasticized material;
  • Articles containing the substances in question (either singly or in combination) in a concentration equal to or greater than 0.1% by weight of the plasticized material can not be placed on the market after 7 July 2020. However, the exemption contains several exemptions for this point.

In the same Journal the Implementing Decision (EU) 2018/2013 was also published, which identifies the 1,7,7-trimethyl-3 (phenylmethylene) bicycle [2.2.1] heptan-2-one (3-benzylidene camphor ) as an extremely worrisome substance pursuant to Article 57, letter f) of Regulation (EC) no. 1907/2006 (REACH) due to its properties of endocrine disrupting with probability of serious effects on the environment.

As a result, the substance is included in the Candidate List.

Please note that from the time of inclusion in the Candidate List, communication obligations are triggered by the companies.
