CLP: 13 ° Adaptation to Technical Progress (ATP) of the CLP Regulation

The Regulation (EU) 2018/1480, which represents the 13th Adjustment to Technical Progress (ATP) of the CLP Regulation, has been published in the Official Journal of the European Union.

 


The new features introduced are:

  • list of substances for which the harmonized classification has been introduced or modified; The Annex to Regulation (EU) 2018/669 provides for the translation of the names of the substances listed in Table 3.1 of Annex VI of Regulation (EC) No. 1272/2008. It is not necessary to comply immediately with new or updated harmonized classifications.
  • modification of the header of the second column of Table 3 of Annex VI, which has been changed from "International identification data" to "Chemical name";
  • adjustment of the 10th ATP (EU Regulation 2017/776 (4)) whose provisions, with the exception of the amendment to Table 3 of CLP Annex VI, apply from 1 June 2017 and no later than 1 December 2018 Although retroactive, this purely formal change does not affect the rights and obligations of manufacturers, importers, downstream users or suppliers.

WHEN TO APPLY THE NEW DISPOSITIONS?

The harmonized classifications introduced with the 13th ATP apply from 1 May 2020. Suppliers can apply the new harmonized classifications even before that date, on a voluntary basis.

From 1 May 2020, both substances and mixtures on shelves with a classification that is not adequate for the 13th ATP will be withdrawn from the market, reclassified and re-labeled.

In case of modification of classification of a substance, the supplier of the same has the obligation to update consequently the eventual REACH Registration dossier and the C&L Notification foreseen by the art. 40 of the CLP.
The modification of the classification of a mixture, on the other hand, leads to an update of the eventual notification to the Hazardous Preparation Archive of the Istituto Superiore di Sanità as required by Legislative Decree n. 65 of 2003.

The changes related to the change of heading of the second column of Table 3 of Annex VI apply from 1 December 2019.
