ECHA: Annex XVII update of the REACH Regulation

On October 12, Regulation (EU) 2018/1513 was published, which modifies Annex XVII of the REACH Regulation.

The European Commission has used a simplified procedure (Article 68) in order to propose the restriction of CMR substances according to a faster procedure.

The Regulation introduces the restriction on the use of 33 CMR substances that may be present in clothing and related accessories, other textiles or footwear through contact with skin or inhalation.

These substances must be equal to or lower than the% reported in this Regulation and intended for consumers.

However, they do not fall within the scope of the restriction:

  • items of clothing, related accessories and footwear, or parts of clothing, related accessories or footwear, which are entirely made of leather, furs or natural leather
  • decorative accessories and non-textile fasteners should not be affected by the new restriction
  • carpet and floor coverings of textile materials for indoor use, carpets and lanes
  • personal protective equipment
  • medical devices;
  • disposable articles, for which however the exemption refers only to letter b).

The new Regulation will enter into force on 1 November 2018.
