COSMETICS: OMNIBUS ACT - PROHIBITED CMR SUBSTANCES IN COSMETIC PRODUCTS

Last 23 May 2019, Reg 831/2019 (or Omnibus Act) was published in the Official Journal of the European Union.

This is a regulatory update with very important implications about the use of numerous substances evaluated as carcinogenic, mutagenic or toxic for reproduction (CMR).
These substances, considered as such pursuant to Regulation (EC) No. 1272/2008, have always been prohibited in cosmetic products (art. 15 of Reg. 1223/2009), especially those of class 1A and 1B, while those belonging to class 2 could be used exceptionally, following approval by SCCS.

The need of a legislative adjustment about these substances arose from the fact that they were prohibited by Article 15 of the Regulation, but they did not appear, or at least not all of them, in Annex II, creating an unclear regulatory situation and a risk of ambiguity.

The Omnibus Act is the European regulation with which all the substances classified as CMR pass automatically into Annex II and are formally prohibited for cosmetic use. The news regulation also transfers in Annex III the CMR substances with possible use following authorization by SCCS.

The decree entered into force on 12 June 2019.
