DIRECTIVE- SINGLE-USE PLASTIC PRODUCT AND ENVIRONMENT: NEW PROVISIONS

DIRECTIVE (EU) 2019/904 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of June 5, 2019 on the reduction of the impact of certain plastic products on the environment:

The aim of the directive is to prevent and reduce the impact of single-use plastic products, oxo-degradable plastic products and plastic-containing fishing gear on the environment and on human health, and to promote the transition to a circular economy.

By 3 July 2021, Member States are required to notify to the Commission and publish a program with the measures they intend to adopt in order to produce, by 2026, a quantifiable reduction in the consumption of disposable plastic products compared to 2022.

The measures include provisions of various kinds aimed at reducing consumption, making available reusable alternatives to disposable plastic products and market restrictions to prevent these products being dispersed into the environment.

In particular, the obligations set out in the Directive include:

 to avoid the marketing of some products listed in part B of the Annex (ART. 5)
 to allow the placing on the market only of those products of part C of the annex whose caps and lids remain attached to the containers for the entire duration of the intended use (ART. 6)
 to make the consumer aware, by affixing to the product a marking that informs the correct methods of management and disposal of the waste and the negative incidence of the dispersion or other forms of improper disposal of the waste (ART. 7)
 to ensure that the producers of single-use plastic products cover the costs of raising awareness, collecting, removing and treating waste (ART. 8)

By adopting the measures indicated in the Directive, Member States should be able to ensure, by 2029, the recycling of a quantity of waste of single-use plastic products (listed in Part F of the Annex) equal to 90% w/w of such products placed on the market in a given year.

Member States are required to bring into force the provisions necessary to comply with the Directive by 3 July 2021.

However, Member States apply the necessary provisions to comply:
- in Article 5 starting from 3 July 2021;
- Article 6 from 3 July 2024;
- in article 7 starting from 3 July 2021;
- in Article 8 by 31 December 2024.
