COMMISSION IMPLEMENTING REGULATION (EU) 2019/1692

On 9 October 2019, the Commission adopted Regulation 1692/2019 concerning the application of the REACH provisions on registration after the expiry of the registration deadline (1 June 2018) for substances subject to a transitional regime.

The Regulation states that:

· The specific method for calculating the quantities per year of substances subject to a transitional regime, referred to in Article 3, paragraph 30, of Regulation (EC) 1907/2006, based on the average production or import volumes of the three previous years, it will continue to apply only until 31 December 2019. After this date, once the substance has been registered, the quantity must be calculated in accordance with the provisions of Article 3 (30) of Reg 1907/2006.

· The expiration of the transitional regime for substances in small volumes does not affect the applicability of Article 12, paragraph 1, letter b, of Reg 1907/2006, which establishes less stringent requirements for the registration of the aforementioned substances.

· After registering a substance, registrants are required to continue to comply with data sharing obligations as specified in Reg 1907/2006 Title III.

· In the event of failure to agree on data sharing, the provisions of Article 30 of the REACH Regulation only apply until 31 December 2019. After this date, pre-registrations made pursuant to Article 28 of the REACH Reg will no longer be valid.
