COSMETIC REGULATION: PUBLISHED THE 2nd OMNIBUS ACT

The Regulation (EU) 2019/1966 (or Omnibus Act 2019), which modifies Annexes II, III and V of Regulation 1223/2009, was published on the Official Journal of the European Union on November 28.

The purpose of the Regulation is to prohibit or restrict the use of CMR substances in cosmetic products pursuant to Reg CLP. In particular, all CMR substances present in Regulation (EU) 1480/2018, for which the industry has not submitted a request for derogation, are included in Annex II (list of prohibited substances), together with other 18 substances or groups of substances classified CMR in Regulation (EU) 1179/2019.

For some substances the use is permitted only under certain conditions and should therefore modify Annex III.

The Regulation (EU) 2019/1966 enters into force December 19, 2019 and is applicable from 1 May 2020.
