CLP: 14th ATP (Adaptation to Technical and Scientific Progress)

The 14th ATP (DELEGATED REGULATION (EU) 2020/217) has been published, which modifies Annex VI of the CLP Regulation, including a list of substances with harmonized classification and labeling.

The Regulations foresee:

  • a list of substances for which harmonized classification has been introduced or modified;
  • the correction of Annex VI of the CLP regarding the substance "pitch, coal tar, high temperature".
  • the classification as Category 2 carcinogen of titanium dioxide.

TITANIUM DIOXIDE

Lung carcinogenicity of titanium dioxide is associated with the inhalation of respirable TiO2 particles, retention and poor solubility of the particles in the lungs, the definition of respirable titanium dioxide particles has been included.

Specific notes have been indicated for the classification and labeling that contain it to avoid unjustified classification.

The conditions reported are:

  • classification Carcinogen Cat.2 (H351 by inhalation): the classification applies only to the TiO2 substance in powder containing ≥ 1% of particles with aerodynamic diameter ≤ 10 μm and to mixtures in the form of powders containing ≥ 1% of TiO2 particles in the form di, or incorporated in, particles with an aerodynamic diameter ≤ 10 μm;
  • no classification but obligation to carry the phrase EUH211 on the label: “Attention! In case of vaporization dangerous respirable droplets may form. Do not breathe vapors or mists ": in the case of liquid mixtures containing ≥ 1% of TiO2 particles with an aerodynamic diameter of 10 μm or less;
  • no classification but obligation to carry the phrase EUH212 on the label: “Attention! When used, hazardous respirable dust may form. Do not breathe the dust ": in the case of solid mixtures containing ≥ 1% of TiO2 particles.

The harmonized classifications included in the 14 ATP (including titanium dioxide) apply, to substances and mixtures, from 9 September 2021.

Suppliers can voluntarily apply the new harmonized classifications prior to that date.

 

Disposal of stocks is not foreseen by the regulation therefore from 9 September 2021 it is necessary to withdraw the mixtures from the shelves and re-label them.
