REACH: Regulation 878/2020 timing of application for the new SDS

On 1 January 2021, the EU Regulation 878/2020 on SDS comes into force, amending Annex II of the REACH Regulation.

However, all SDSs drawn up in accordance with Regulation 830/2015 can continue to be provided until 31 December 2022. (Art. 2 Reg. 878/2020).

From 1 January 2021 to 31 December 2022 SDS can be provided drawn up according to Reg. 830/2015 or Reg. 878/2020 in the following cases:

SDS that do not need to be updated
New SDS provided for substances / mixtures placed on the market for the first time after 1 January 2021
SDS that require minor changes
SDS that require updates according to art. 31.9 or introducing the UFI

After 31 December 2022 all SDSs must be provided only in the format according to Regulation (EU) 2020/878.
