COSMETICS: new Regulations amending Annexes II, III and IV

The Official Journal of the European Union (GUUE) L 202 of 3 August 2017 and L 203 of 4 August 2017 published two Regulations for adaptation to the technical progress of Annexes II, III and IV

  • Regulation (EU) 2017/1410 of 2 August 2017 amending Annexes II and III to Regulation (EC) 1223/2009 adapts technical progress to Annexes II and III to Regulation (EC) 1223/2009, also with reference to the SCCS Scientific Committee, updating the rules of HICC (Hydroxyisohexyl 3-cyclohexene carboxaldehyde), Atranol and Chloroatranol by inserting them in Annex II and forbidding cosmetic use. The voice no. 79 of Annex III authorizing the use of HICC is suppressed.

The adjustment times include:
- from 23 August 2019 cosmetics containing one or more of these substances will not be placed on the EU market;
- from 23 August 2021 no cosmetic products containing one or more of those substances will be made available on the EU market

  • Regulation (EU) 2017/1413 of 3 August 2017 amending Annex IV to Regulation (EC) No. 1223/2009 adapts technical progress to Annex IV to Regulation (EC) 1223/2009, also with reference to the SCCS Scientific Committee, updating cosmetic use as a non-coated zinc oxide dye (CI 77947) , in its non-nano form by inserting the following restriction: Do not use in applications that may result in the inhalation final user's lungs exposure. This substance is currently regulated by no. 144 of Annex IV to Regulation (EC) No. 1223/2009.

The adjustment times include:
- from 24 February 2018 only compliant cosmetics will be placed on the EU market;
- from 24 May 2018, only compliant cosmetics will be available on the EU market.
