POISON CENTER: Annex VIII CLP

Following the issue of Regulation (EU) 2017/542 of 22 March 2017, 1 February 2018, the Commission and ECHA jointly organized a seminar on the implementation of Annex VIII of the CLP Regulation.

This regulation has introduced some news on notifications according to the art. 45 of the CLP. The aim is to harmonize the requirements to be provided during notifications in all Member States

The information to be provided in the notification are:

  • the UFI code (Unique Formula Identifier): it is a 16-digit code to be included on the label and in the SDS, this code will be mandatory starting from 1 January 2020.
  • details of the responsible person
  • product identifiers and details such as the trade name, color and type of packaging;
  • hazard categories: indicate in the notification the product category, must be selected by the EU product categorization system (EU PCS)
  • toxicological information such as the likely route of exposure and symptoms caused by exposure to the chemical;
  • the elements of the hazard classification label such as physical and health hazards, pictogram codes, signal words and hazard and precaution statement codes

ECHA will provide the harmonized format required for notifications. The Agency has also launched the development of a Poison Control Notification Center (NCP) that will allow companies to present information centrally and send notifications to designated bodies and poison centers in the Member States where the product is placed. on the market.

HOW TO PROCEED:

  • Identify your obligations
  • Know your product portfolio
  • Identify your deadlines
  • Prepare for internal mapping of the formulation codes to generate UFIs
  • Generate your UFIs
  • re-label the products
  • prepare notifications in the correct language

The authorities are still working:

- on the harmonized notification format
- whether to use the ECHA portal to receive notifications


DEADLINES:

The gradual deadlines are before January 1st:

  • 2020 for consumer use;
  • 2021 for professional use;
  • 2024 for industrial use only.

The mixtures that were already on the market when this obligation was imposed will have to be notified again by the end of the transition period, 1 January 2025.
