REACH: Pre-registration and Registration

To be able to register non-phase-in substances (not subject to a transitory regime) or that have not been pre-registered, it is necessary to submit an inquiry. The inquiry consists of submitting a reduced dossier containing information necessary for the identification of the substance, so that the Agency can put potential registrants in contact with the companies that previously registered the same substances, so as to be able to share the information.

The interpretation of the REACH Regulation led to thinking that after 31 May 2018 the pre-registrations would have lost their validity. For those substances that had been pre-registered but not registered by that date it was thought necessary to submit an inquiry to proceed with registration.

However, a legislative gap emerged that in the Regulation it is not specified that the phase-in substances (the pre-registered substances) cease to be such after May 31st. As a result, to date it is still possible to register pre-registered substances using the pre-registration number and without having to resort to the inquiry.
