Cosmetic products placed on the French market are regulated by the following regulations:
-Regulation (EC) 1223/2009;
-Code de la santé publique (CSP).
The competent authorities responsible for cosmetic products sold in France are the Agence nationale de sécurité du médicament et des produits de santé (ANSM) and the Direction générale de la concurrence, de la consommation et de la répression des fraudes (DG CCRF). These authorities verify compliance with regulatory requirements through in-market control activities.
Language requirements: all information on the labels of cosmetics sold in France must be translated into French.
Concerning documentation kept by the responsible person (PIF, CPSR..), it must preferably be in French, but documentation in English is also considered acceptable.
Notifications: All establishments based in France that produce or distribute cosmetic products must register on the ANSM online portal. Importers are not subject to the establishment declaration.
However, French manufacturers, importers and distributors of cosmetic products containing nanomaterials are required to make an annual declaration to the R-Nano register.
Other requirements:
- cosmetic products requiring a challenge test may only be sold in bulk through an assisted service.
- The packaging of cosmetic products (as well as all other products) must be appropriately labelled with the Triman logo.
