COSMETICS: VI OMNIBUS ACT PUBLISHED – REGULATION 2023/1490

On 20 July 2023, the European Commission published Regulation (EU) 2023/1490, the Omnibus Act VI.

This regulation implements the 18th ATP of the CLP Regulation, and thus introduces substances classified as CMR (carcinogenic, mutagenic or toxic for reproduction) into Annex II of the Cosmetics Regulation.

The most impactful changes concern the prohibition of the following substances:

-Benzophenone (CAS 119-61-9)
-Theophylline (CAS 58-55-9)
-Melamine (CAS 108-78-1)
-Azadirachta Extracts (CAS 84696-25-3)
-Trimethylolpropane Triacrylate (CAS 15625-89-5)
-Pentetic Acid (CAS 67-43-6)
-Pentasodium pentetate (CAS 140-01-2).

Entry 1024 of Annex II of Reg 1223,2009, which prohibits the use of 2-ethylhexanoic acid (2-Ethylhexanoic acid – CAS: 149-57-5) in cosmetics, has also been amended to include the relevant salts of the substance in the prohibition.
