The United Kingdom, following its exit from Europe, is preparing specific regulations for cosmetic products and chemicals.

The Government of the United Kingdom has published “Appointing nominated persons to your business if there’s no Brexit deal“.

From March 2019, in the absence of an agreement, any person appointed in the UK will no longer be recognized at EU level.

Companies located in the EU will not be impacted in the short term and will continue to market products in the EU and the UK, while businesses with an authorized representative based in the UK will no longer be able to rely on this representative to perform all the tasks required for products placed on the EU market.

However, new authorized representatives will have to be based in the United Kingdom to be recognized by the law of the United Kingdom.

Companies with an authorized representative based in the United Kingdom will have to establish a new authorized representative in an EU country if they want an authorized representative to perform tasks on their behalf within the EU.

Companies wishing to appoint a new authorized representative to carry out activities on their behalf in the United Kingdom will have to appoint a representative based in the United Kingdom.

For cosmetics, responsible persons established in an EU country will no longer be recognized by the United Kingdom after March.

Companies wishing to place cosmetics in the UK market will have to appoint a responsible person based in the United Kingdom.

Companies placing cosmetic products on the EU market will not be able to use a responsible person located in the UK to place a product on the EU market.
